Wonder how this would get around someone who has an updated birth certificate before they’re arrested. Issuance of identification documents like that are a power reserved to the states and must be given full faith and credit.

Wholeheartedly agree, the cruelty is the point.
Nothing in the constitution demands that we segregate prisoners by sex or gender.
Doing so is just a fair shortcut to avoiding the cruel punishment of denying prisoners safety from assault in prison, but these RWNJs think prison is supposed to be inhumane.
I’ve never understood it. Inmates are sentenced to giving up their freedom, that’s it. That’s the only thing we should be taking from them.
So it’s ok for men and women to share prisons? I’m sure the men would be up for that.
I have the feeling that there will be some heterosexual male prisoners that will like this and some heterosexual male prisoners that will end up liking it. It is going to be a big dangerous mess.
